IMPORTANT: PLEASE READ THESE TERMS CAREFULLY. BY USING OUR SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. THE SECTIONS TITLED “BINDING ARBITRATION” AND “CLASS ACTION WAIVER” CONTAIN IMPORTANT PROVISIONS THAT AFFECT YOUR LEGAL RIGHTS.

1. INTRODUCTION AND ACCEPTANCE

These terms apply globally to users outside the EU/EEA. Where the mandatory local law of your country provides different protections, those provisions prevail.

Welcome to Innate Q! These Terms of Service (“Terms,” “Agreement”) constitute a legally binding agreement between you (“User,” “you,” “your”) and Affect Group Inc (“Innate Q,” “Company,” “we,” “us,” “our”), governing your access to and use of the Innate Q website located at innateq.ai and app.innateq.ai (the “Website”), mobile applications (the “App”), and all related services (collectively, the “Services”).

BY ACCESSING, BROWSING, OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS AND OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICES.

We reserve the right to modify these Terms at any time. Material changes will be notified via the Services or email. Your continued use of the Services after changes constitutes acceptance of the modified Terms.

2. DESCRIPTION OF SERVICES

2.1 Service Overview

Innate Q provides AI-powered personality and talent analysis services based on birth data (date, time, and place of birth). Our Services include:

Talent Analysis: Calculation of 180 innate potentials based on over 150,000 parameters

AI Psychological Profiles: Generation of detailed personality profiles using artificial intelligence

AI Mentor: Personalized recommendations, insights, and responses to your queries

Daily AI Insights: Personalized daily recommendations and guidance (subscription feature)

Compatibility Analysis: Comparison with friends via personal codes (with mutual consent)

Knowledge Base: Educational content about talents and personal development

Birth-Time Rectification: An analytical service that estimates a likely birth time from your structured questionnaire responses and significant life events, using a proprietary computational methodology. Available as a premium service in select plans.

Shadow Profile Module: An analytical portrait of predispositions that may manifest as hindering (“shadow”) behaviour patterns, with access to the Shadow Mentor — an AI mentor for working through them. Available as a separate one-time purchase (premium service) for users 18+ (see Section 2.5).

2.2 Nature of the Service

Innate Q provides self-knowledge insights based on date, time, and place of birth using a proprietary methodology. Insights are intended to complement, not replace, the user's own judgment and consultation with qualified professionals. The AI-generated profiles, talent scores, insights, and recommendations are NOT:

Medical, psychological, or psychiatric diagnosis, advice, or treatment

Professional counseling, therapy, or mental health services

Career placement, hiring, or recruitment decisions

Financial, legal, or investment advice

A substitute for professional assessment, evaluation, or consultation

You should NOT rely on the Services as the sole basis for any important life decisions. Always consult qualified professionals for medical, psychological, legal, financial, or career advice.

2.3 Birth-Time Rectification (Premium Service)

Birth-Time Rectification is a premium analytical service available in select plans. It estimates a likely birth time from your structured questionnaire responses and significant life events, using a proprietary computational methodology that may include iterative analysis, comparison of computed profiles across candidate times, and clarifying follow-up questions sent by email.

Nature of the Service.

The estimated birth time and any insights derived from it are intended as reflective tools to complement, not replace, your own judgment and the advice of qualified professionals. We do not guarantee the accuracy of the estimate, make no predictions about future events, and do not offer medical, psychological, legal, financial, or career counseling. Where applicable law regulates "fortune telling," divination, or analogous services, this Service is offered solely as a self-knowledge analytical methodology and not as such regulated activity.

Beta / Pilot Status.

The methodology is undergoing ongoing validation. We do not guarantee any specific accuracy threshold, and you acknowledge that the estimate is a best-effort result based on the information you provide.

Your Obligations.

You are responsible for providing truthful and accurate event data. Inaccurate or incomplete responses may produce an incorrect estimate and are not grounds for a refund.

Authorized Personnel.

Performance of the Service involves manual review of your questionnaire responses by authorized personnel acting under written confidentiality obligations and, where applicable, supervised AI processing tools. See our Privacy Policy for details.

Refund Policy for Rectification.

Because rectification requires manual review of your responses, refund eligibility depends on stage:

Full refund if you have not yet submitted the questionnaire.

Partial refund (50%) within 7 days of submission if no follow-up questions have been sent and no final result has been delivered.

No refund after the final result has been delivered or after follow-up questions have been answered.

2.4 Public Figure Demonstration Profiles

Innate Q may display demonstration profiles of public figures (celebrities, business leaders, historical figures, etc.) for illustrative purposes. These profiles are calculated algorithmically using publicly available birth date data from open sources (Wikipedia, public records, biographical databases).

The calculations are provided solely to demonstrate how the Service works. We make no claims regarding the accuracy of these profiles or their correspondence to any real person’s actual abilities or characteristics. The display of public figure profiles does not constitute advertising.

2.5 Shadow Profile Module (Premium Service)

The Shadow Profile module is a premium self-development tool available as a separate one-time purchase. Based on your birth data, it computes an analytical portrait of predispositions that may manifest as hindering (“shadow”) behaviour patterns, and includes access to the Shadow Mentor — an AI mentor for working through these shadow sides and transforming them into healthy forms for self-development and the realization of your potential. The shadow profile and the Shadow Mentor’s responses are generated by an AI system.

Nature of the Module.

The module describes predispositions computed using our proprietary methodology from your birth configuration. It is not a diagnosis, a psychological assessment, or a statement of fact about you, and it is not psychological diagnostics, therapy, or a substitute for them. The Shadow Mentor is not a therapist or a licensed professional. The materials are intentionally written in direct language and may address uncomfortable sides of personality. The AI Mentor terms in Section 6, including its limitations and its inability to provide crisis intervention, apply in full to the Shadow Mentor, except that Shadow Mentor conversations are used solely to provide the module and are not used to improve services or to train AI models (see the Privacy Policy).

Eligibility (18+).

The module is available only to users who are at least 18 years of age, and only for your own profile. It is not available on accounts registered by a parent or legal guardian to analyze a child’s data, and it is not offered for children’s profiles.

Activation Acknowledgements and Consent.

Before the purchase you must confirm the acknowledgements presented at activation: that you are 18 years of age or older; that you understand the module is a self-development tool and not psychological diagnostics, therapy or a substitute for them; that you are making the decision consciously and will use the materials at your own responsibility; that you will have no claims against the service regarding the content of the shadow profile or the Shadow Mentor’s responses; and that you are ready for a direct conversation about yourself. You must also give a separate explicit consent to the processing of your shadow questionnaire answers and Shadow Mentor conversations (see the Privacy Policy). The module cannot be activated without these confirmations.

Shadow Mentor Requests.

The module price does not include AI Mentor request credits. Each Shadow Mentor response deducts two (2) requests from your shared AI Mentor request balance, because each shadow-work request processes substantially more information (your talent profile, questionnaires, and shadow materials). Additional requests may be purchased as message packages under Section 9.1. The shadow profile itself remains available in your account regardless of your request balance.

Refunds.

The general refund policy in Section 9.4 applies to the module: the service is considered rendered at the moment the shadow profile is displayed. No special refund terms apply to the module.

Limitation of Liability.

To the maximum extent permitted by applicable law, the disclaimers in Section 11 and the limitation of liability in Section 12 apply in full to the module, including the content of the shadow profile, the Shadow Mentor’s responses, and emotional reactions to these materials.

3. ELIGIBILITY

To use the Services, you must:

Be at least 16 years of age (or the age of digital consent in your jurisdiction, if higher)

Confirm your age during registration by checking the required checkbox

Have the legal capacity to enter into a binding agreement

Not be prohibited from using the Services under applicable laws

Provide accurate and complete information during registration

Children's Data and Parental Consent: Innate Q does not allow direct registration by users under 16. Parents or legal guardians may register on behalf of a minor, in which case the parent or guardian acknowledges they hold parental authority and consent to the processing of the minor's data; the registration email and verification link confirm parental consent; and all rights and obligations under these Terms apply to the parent or guardian acting on behalf of the minor. Parents and legal guardians may also use our Services to analyze birth data of their children of any age; by entering a child's birth data, the parent or guardian confirms they have the legal authority to consent to data processing on behalf of the child. If you believe a child under 16 has created an account without parental consent, please contact us at [email protected].

4. ACCOUNT REGISTRATION AND SECURITY

4.1 Account Creation

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete registration information

Maintain and promptly update your account information

Keep your password confidential and secure

Notify us immediately of any unauthorized account access

Accept responsibility for all activities under your account

4.2 Birth Data Accuracy

The accuracy of the analysis depends on the accuracy of the birth data you provide. The analysis results are intended to support self-knowledge and personal reflection only, and we are not responsible for any decisions made based on them, regardless of the accuracy of the data provided.

4.3 Account Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason, including violation of these Terms. Upon termination, your right to use the Services ceases immediately.

5. USER CONDUCT AND PROHIBITED ACTIVITIES

By using the Services, you agree NOT to:

Provide false, misleading, or inaccurate information

Impersonate any person or entity

Use another user’s account without permission

Create multiple accounts for fraudulent purposes

5.2 Content Prohibitions

Post content that is defamatory, obscene, threatening, or harassing

Share content that promotes violence, discrimination, or hatred

Upload content that infringes intellectual property rights

Distribute spam, advertisements, or unsolicited communications

Share personal information of others without their consent

5.3 Technical Prohibitions

Attempt to gain unauthorized access to our systems or networks

Use automated means (bots, scrapers) to access the Services

Reverse engineer, decompile, or disassemble any part of the Services

Introduce viruses, malware, or other harmful code

Interfere with the proper functioning of the Services

Circumvent security measures or access controls

5.4 AI System Prohibitions

Attempt to jailbreak, manipulate, or bypass AI operational constraints

Use prompt injection or other techniques to circumvent content policies

Attempt to extract system prompts or training data

Engage in adversarial testing without authorization

Use the AI Mentor for illegal, harmful, or unethical purposes

6. AI MENTOR SPECIFIC TERMS

6.1 Nature of AI Mentor

The AI Mentor is an artificial intelligence system, NOT a human. It provides content and responses to support self-knowledge and personal reflection. The AI Mentor is NOT a licensed professional and its responses should not be considered professional advice for medical, psychological, legal, financial, or career matters.

6.2 Limitations

The AI may not understand or correctly process all information you share

Responses may contain inaccuracies or be inappropriate for your situation

The AI cannot respond to emergencies or provide crisis intervention

AI conversations are logged and may be used to improve services

6.3 Third-Party Information

WARNING: Do not share personal information about third parties without their consent. The AI may inadvertently process, analyze, or reference information about others. You assume responsibility for any information you share about other people.

7. FRIEND COMPARISON AND SOCIAL FEATURES

7.1 Personal Codes

Innate Q allows you to share your profile with friends via personal codes. By sharing your code, you consent to sharing the following information:

All 180 calculated talent scores

Portions of your AI-generated psychological profile

Compatibility analysis data

7.2 Consent and Responsibility

Only share your code with people you trust

You may generate a new code to revoke previous access

You are responsible for how your shared data is used by recipients

7.3 Public Profile Sharing

You may create a public share page displaying your name, top talents, archetypes, and AI-generated descriptions. By creating a public share link, you understand and agree that:

This information becomes publicly accessible to anyone with the link

Your public share page may include your referral link

You may deactivate your public share page at any time through your account settings

You are responsible for any consequences of sharing your profile publicly

8. INTELLECTUAL PROPERTY RIGHTS

8.1 Our Intellectual Property

All content, features, and functionality of the Services, including but not limited to text, graphics, logos, icons, images, audio clips, software, algorithms, and the compilation thereof, are the exclusive property of Innate Q or its licensors and are protected by copyright, trademark, and other intellectual property laws.

8.2 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes. This license does not include any right to:

Modify, copy, distribute, or create derivative works

Use the Services for commercial purposes without authorization

Remove or alter any copyright or proprietary notices

Transfer your access to any third party

9. PAYMENTS AND SUBSCRIPTIONS

9.1 Payment Options

Innate Q offers the following payment options:

One-Time Purchase: Access to talent calculation, AI profile generation, knowledge base, additional AI queries, and one month of daily insights

Subscription: Ongoing access to daily AI insights generation (monthly or other periods)

Message Packages: Additional AI Mentor message credits

Shadow Profile Module: One-time purchase of the shadow profile and Shadow Mentor access (AI request credits not included; each Shadow Mentor response deducts 2 requests from the shared request balance)

9.2 Auto-Renewal

Subscriptions automatically renew unless cancelled before the end of the billing period

You may cancel subscriptions through your account settings or app store

Cancellation takes effect at the end of the current billing period

Deleting the app does not automatically cancel your subscription

9.3 Pricing

Prices are displayed in USD and may vary. We reserve the right to change prices at any time. Promotional discounts may apply under certain conditions.

9.4 Refunds

Refunds are not issued after the User has received their talent calculation results, as the service is considered rendered at the moment the results are displayed. Exceptions apply only in case of a technical failure that prevents delivery of the service, and at the Company's sole discretion. Purchases made through the Apple App Store or Google Play are subject to their respective refund policies. Subscriptions may be cancelled at any time via account settings; cancellation does not refund amounts already paid for the current billing period.

10. REFERRAL PROGRAM

Innate Q may offer referral rewards for users who invite others to the Service.

Rewards (such as additional AI Mentor requests) are credited when the referred user completes a qualifying purchase

Rewards are non-transferable and have no cash value

We reserve the right to modify or terminate the referral program at any time without prior notice

Abuse of the referral system (including fake accounts, self-referrals, or fraudulent activity) may result in forfeiture of rewards and account termination

11. DISCLAIMERS

10.1 “AS IS” Basis

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.

10.2 No Professional Advice

WE DO NOT PROVIDE MEDICAL, PSYCHOLOGICAL, LEGAL, FINANCIAL, OR CAREER COUNSELING SERVICES. THE CONTENT GENERATED BY OUR SERVICES IS INTENDED TO SUPPORT SELF-KNOWLEDGE AND PERSONAL REFLECTION, AND IS NOT A SUBSTITUTE FOR ADVICE FROM QUALIFIED PROFESSIONALS. YOU SHOULD ALWAYS SEEK THE ADVICE OF QUALIFIED PROFESSIONALS FOR IMPORTANT DECISIONS.

10.3 Accuracy Disclaimer

We do not guarantee the accuracy, completeness, or usefulness of any information provided by the Services for any specific purpose or individual. AI-generated content may contain errors, omissions, or inaccuracies. Talent scores and psychological profiles are generated using a proprietary methodology; while the methodology is supported by internal validation research, individual profiles may not perfectly reflect any specific person's characteristics.

10.4 Public Figure Profiles Disclaimer

Demonstration profiles of public figures are algorithmic calculations based on publicly available birth date data. They are provided solely to demonstrate the Service’s capabilities. We make no claims regarding their accuracy or correspondence to any real person’s actual abilities.

12. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

IN NO EVENT SHALL Innate Q, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

THE TOTAL LIABILITY OF Innate Q SHALL NOT EXCEED THE FEES YOU PAID TO Innate Q IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, BUT IN ANY CASE SHALL NOT BE LESS THAN THE LESSER OF (A) ONE HUNDRED US DOLLARS (USD 100) OR (B) THE AMOUNT YOU ACTUALLY PAID TO Innate Q.

WE SHALL NOT BE LIABLE FOR ANY DAMAGES RESULTING FROM: (A) YOUR USE OR INABILITY TO USE THE SERVICES; (B) ANY DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICES; (C) UNAUTHORIZED ACCESS TO YOUR ACCOUNT; (D) ERRORS OR INACCURACIES IN AI-GENERATED CONTENT; (E) ANY THIRD-PARTY CONTENT OR CONDUCT.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

13. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Innate Q and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including attorney’s fees) arising from:

Your violation of these Terms

Your violation of any third-party rights

Any content you submit to the Services

Any decisions you make based on information from the Services

14. DISPUTE RESOLUTION

14.1 Informal Resolution

Before filing any formal dispute, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

14.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS.

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services shall be resolved by binding arbitration administered by the American Arbitration Association under its applicable rules. The arbitration shall be conducted in English and held in Sacramento, California, United States. The arbitrator’s decision shall be final and binding.

14.3 Class Action Waiver

YOU AND Innate Q AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate more than one person’s claims and may not otherwise preside over any form of class or representative proceeding.

14.4 Opt-Out

You may opt out of the arbitration agreement by sending written notice to [email protected] within 30 days of first accepting these Terms. The notice must include your name, address, email, and a clear statement that you wish to opt out.

15. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. For users in the European Union, nothing in these Terms affects your rights under mandatory consumer protection laws of your country of residence.

16. MODIFICATIONS TO SERVICES AND TERMS

We reserve the right to modify, suspend, or discontinue the Services at any time without notice. We may also modify these Terms at any time. Material changes will be communicated via the Services or email. Your continued use after changes constitutes acceptance.

17. TERMINATION

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination:

We may delete your account and data in accordance with our Privacy Policy

Provisions that by their nature should survive will remain in effect

18. GENERAL PROVISIONS

18.1 Entire Agreement

These Terms, together with our Privacy Policy and Community Guidelines, constitute the entire agreement between you and Innate Q regarding the Services.

18.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

18.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

18.4 Assignment

You may not assign or transfer these Terms or your rights without our prior written consent. We may assign our rights and obligations without restriction.

18.5 Force Majeure

We shall not be liable for any failure to perform due to causes beyond our reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or technical failures.
